ABC Veto Session Issues
The Illinois General Assembly returns this month for the Veto Session. Scheduled for November 13, 14, 15, 27, 28 and 29th, the Veto Session provides lawmakers an opportunity to consider vetoes by Governor Rauner. To override a veto, 71 votes are required in the House and 36 in the Senate.
Here are some of the issues we are working on behalf of ABC.
SB 904 (Hastings/Hoffman) will allow medical providers to pursue workers’ compensation medical bill payments in circuit court. No other state in the country allows bill collection issues to proceed in court before the issue is resolved administratively. There are a number of changes proposed in this measure that we believe could work against employers’ abilities to control medical costs. ABC Supports veto Governor Amendatory Veto Message
SB 3052 (Mulroe/Arroyo) Under the Contractor Prompt Payment Act, allows for a retainage of 10% of the payment to be withheld from a payment under a construction contract prior to the completion of 50% of the contract. After 50% of the contract is completed, the amount of retainage for any subsequent payment cannot exceed 5%. ABC SUPPORTS an override Governor Vetoed
HB 4572 (Guzzardi/Castro) amends the Illinois Human Rights Act to redefine "employer" to include any person employing one (currently 15) or more employees within Illinois during 20 or more calendar weeks within the calendar year of or preceding the alleged violation. HB 4163 (Moeller/Castro) amends the Equal Pay Act of 2003 prohibiting an employer from inquiring about salary and wage history by adding new standards that limit employer defenses and adding new compensatory and punitive damage penalties on businesses who are not compliant.
